This Lersia Play Viewer Terms of Service Agreement (“Agreement”) is between you and Lersia (for the purposes hereof, “Lersia,” “we,” or “us”). The Agreement governs your use of the Lersia Play Service, an online platform that allows consumers like you to view video programs (“Programs”) from content owners and licensors (“Producers”) through Producer-branded websites and applications that we power.
By creating an account, viewing videos, making a purchase, downloading our applications, or otherwise visiting or using the Lersia Play Service, you accept this Agreement and consent to contract with us electronically.
If you are an entity other than a natural person, the person who registers the account or otherwise uses the Lersia Play Service must have the authority to bind the entity. In this context, “you” means both the entity and each person authorized to access the account.
We may update this Agreement by posting a revised version on our website. By continuing to use the Lersia Play Service, you accept the revised Agreement.
You may terminate the Agreement at any time by deleting your account. We reserve the right to suspend or terminate your account for breach of these terms. Upon termination or expiration of the Agreement, the following sections survive: Section 6 (Disclaimers), Section 7 (Limitation of Liability), and Section 8 (Indemnification).
Registration: You must create an account to use certain features we offer (e.g., to view a Program). To do so, you must provide an email address. By creating an account, you agree to receive notices from Lersia at this email address.
Age Requirements: You may not create an account if you are younger than 16 years of age. By creating an account, you represent that you are at least 16 years of age and, to the extent required by law, have the permission of a parent or guardian to create an account and use the Lersia Play Service.
Parents and Guardians: By granting your child permission to use the Lersia Play Service through your account, you agree that you are responsible for monitoring and supervising your child's usage.
Account Security: You are responsible for all activity that occurs under your account, including unauthorized activity. You must safeguard the confidentiality of your account credentials. If you are using a shared or public computer, you must log out of your account after each session. If you become aware of unauthorized access to your account, you must change your password immediately.
Account Sharing: You may not share your account login credentials with anyone else. To enforce this, Lersia monitors account activity — including device, IP address, and approximate location data — for each session. If simultaneous or rapid successive logins are detected from multiple devices or from locations that are geographically inconsistent with normal use, your account may be disabled without further notice.
Please review our Privacy Policy to learn about the information we collect from you when you use the Lersia Play Service — including account, device, and location data collected for service delivery and anti-piracy purposes — how we use it, and with whom we share it.
By creating an account, you agree that Lersia will have access to your account information and account activity, such as the viewing and purchase of Programs, your contact information, and the device and location data described in our Privacy Policy.
Lersia offers the following purchase option through its websites and applications:
Pay-Per-View: You are required to pay a fee to watch the specific Program.
To make a purchase, you must provide a valid payment method. We may apply taxes, including GST (Goods & Services Tax), to any charges. Prices and other terms of purchase are subject to change.
ALL PURCHASES ARE FINAL AND NON-REFUNDABLE, except as described under "Pricing and Payment" below.
License to Programs: Subject to the terms hereof, you have the right to stream, for your personal entertainment purposes, the Programs you have purchased.
Restrictions: You may not resell streams or downloads, use any Program for a commercial purpose, redistribute or retransmit any Program, publicly perform or display any Program, or make derivative works from any Program.
YOUR USE OF THE LERSIA PLAY SERVICE IS AT YOUR OWN RISK. LERSIA PROVIDES THE LERSIA PLAY SERVICE ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. LERSIA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Without limiting the above, Lersia makes no representations or warranties concerning:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LERSIA, ITS PARENT, DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES, CONSULTANTS, AGENTS, SUPPLIERS, AND PARTNERS (INCLUDING PRODUCERS) SHALL NOT BE LIABLE FOR (I) ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES; OR (II) DAMAGES RELATING TO ANY DISPUTE BETWEEN LERSIA USERS.
The foregoing limitations apply to all claims, whether based on warranty, contract, tort, or any other legal theory, whether or not Lersia has been informed of the possibility of such damage, and whether a remedy set forth herein is found to have failed its essential purpose. Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability as set forth above, so these limitations may not apply to you.
You shall indemnify, defend, and hold harmless Lersia and its parent, directors, officers, employees, representatives, consultants, agents, suppliers, and partners (including Producers) from any liability, claim, demand, damages, losses, and costs (including attorneys' fees) arising from: (i) your unauthorized use of any Program; (ii) your breach of this Agreement or violation of any law or third-party right; or (iii) any content you upload or submit to us.
Any unauthorized reproduction or redistribution of content hosted on the Lersia app is expressly prohibited by law and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.
To detect and prevent piracy and unauthorized account sharing, Lersia collects detailed playback data for each viewing session, including device information, IP address, and approximate geographic location (derived from your IP address and, where enabled, device location services). Accounts showing simultaneous or rapid successive access from geographically distant or otherwise implausible locations may be flagged, and access may be suspended or terminated, without prior notice. Lersia Play offers a pay-per-view model to watch movies, films, and TV series available on the platform. Users can choose the content they wish to watch and select the video quality in which they want to watch it; content is priced according to the quality selected.
Users are charged a fixed amount to watch content, and purchased content remains available for viewing for a fixed period. Once a user starts watching purchased content, the viewing-availability period begins counting down: TV series remain available for 4 days, and movies and short films for 3 days, from the moment playback starts.
All content available on the Lersia Play platform is paid content, available for consumption on a pay-per-view basis for the limited period specified at the time of payment. Content is priced individually — by movie, film, or episode — or by full series, and pricing may vary across titles.
Users may request cancellation and a refund on unwatched content where a technical error or other genuine reason applies. Unwatched content is content the user has not started watching, and a full refund may be claimed excluding payment gateway fees and applicable taxes on those fees. For a full series purchase, unwatched episodes are used to calculate the refund amount.
